作品販売規約

 

 

本規約は、夏八木珈琲（以下、「作家」という。）が制作・販売する作品（以下、「本作品」という。）の購入に関する条件を定めるものである。購入者は、本規約を熟読のうえ、同意した場合に限り購入を申し込むものとする。

第1条（作品証明書の発行）

  1. 作家は、購入者に対し、本作品の真正性および価値を証明する「作品証明書」を紙媒体にて発行する。

  2. 作品証明書には、以下の情報を記載する。

    • 作品証明書発行年月日

    • 作家名

    • 作品名

    • 作品の管理番号

    • サイズ

    • 素材

    • 作品イメージ

    • 作家の直筆サイン

  3. 作品証明書は、作品の価値を保証する重要な書類であり、厳重に保管するものとする。

  4. 作品証明書の再発行は、原則として行わない。

  5. 作家は、販売済みの本作品に関する管理番号を適切に管理するものとする。

第2条（販売価格および価格改定方針）

  1. 作家は、本作品の価値維持および向上のため、販売価格を引き下げることは一切行わない。

  2. いかなる理由があっても、割引販売は実施しない。

  3. 作家は、長期的な価値向上を目的として、本作品の販売価格を一定のペースで引き上げる方針を採用する。

  4. 販売価格は市場動向および作家の活動状況により改定する場合があるが、値下げは一切行わない。

第3条（転売および譲渡）

  1. 購入者は、本作品を第三者へ転売または譲渡することができる。

  2. 転売または譲渡に際し、作家の許可を得る必要はない。

  3. 転売価格については、購入者が自由に設定できるものとする。

  4. 転売または譲渡の際は、作家発行の作品証明書を必ず本作品とともに引き渡すこと。

第4条（購入手続および支払方法）

  1. 購入希望者は、作家が指定する販売プラットフォーム（Booth等）を通じて注文するものとする。

  2. 直接販売を希望する場合は、メールまたはお問合せフォームにて作家へ連絡すること。

  3. 海外発送も対応可能とする。

  4. 送料・関税・その他付帯費用は購入者の負担とする。

第5条（作品の引渡しおよび責任範囲）

  1. 展示会・ギャラリー等で展示中の作品は、展示期間終了後に発送する。

  2. 作品は、適切な梱包を施し、破損防止に最大限配慮したうえで発送する。

  3. 本作品の発送後に発生した輸送中の事故（遅延・紛失・破損等）に関して、作家は一切の責任を負わないものとする。

第6条（返品・交換・キャンセル）

  1. 購入確定後の返品・交換・キャンセルは一切受け付けない。

  2. 作品の特性上、質感や色合いの相違を理由とする返品・交換も受け付けないものとする。

  3. 購入者は、本作品を購入した時点で本規約に同意したものとみなす。

第7条（個人情報の取り扱い）

  1. 作家は、購入者の個人情報を厳重に管理し、第三者に提供または開示しないものとする（法令により開示を求められた場合を除く）。

  2. 個人情報は、本作品の販売および発送に必要な範囲内でのみ利用するものとする。

第8条（規約の変更）

  1. 作家は、本規約の内容を随時見直し、必要に応じて変更することができるものとする。

  2. 本規約の変更後、購入者が本作品を購入した場合、変更後の規約に同意したものとみなす。

Terms and Conditions of Artwork Sales

 

 

These terms and conditions (hereinafter referred to as the "Terms") set forth the conditions for purchasing artworks created and sold by Natsuyagi Coffee (hereinafter referred to as the "Artist"). Buyers are required to carefully review and agree to these Terms before making a purchase.

Article 1 (Issuance of Certificate of Authenticity)

  1. The Artist shall issue a "Certificate of Authenticity" in paper form to buyers as proof of the authenticity and value of the purchased artwork (hereinafter referred to as the "Artwork").

  2. The Certificate of Authenticity shall include the following information:

    • Date of issuance

    • Artist's name

    • Title of the artwork

    • Artwork identification number

    • Dimensions

    • Materials used

    • Image of the artwork

    • Artist’s handwritten signature

  3. The Certificate of Authenticity is an essential document that guarantees the value of the Artwork. Buyers must handle it with care and store it securely.

  4. The Certificate of Authenticity will not be reissued under any circumstances.

  5. The Artist shall maintain records of the identification numbers of sold Artworks.

Article 2 (Pricing and Price Revision Policy)

  1. The Artist shall not reduce the selling price of any Artwork under any circumstances to maintain and enhance its value.

  2. No discounts shall be applied for any reason.

  3. The Artist is committed to gradually increasing the selling price of Artworks over time as part of a long-term value enhancement strategy.

  4. The selling price may be revised in consideration of market trends and the Artist’s career progression; however, price reductions will not be implemented.

Article 3 (Resale and Transfer)

  1. Buyers may resell or transfer the purchased Artwork to third parties.

  2. No prior approval from the Artist is required for resale or transfer.

  3. Buyers may set any resale price at their discretion.

  4. When reselling or transferring the Artwork, the original Certificate of Authenticity issued by the Artist must be provided along with the Artwork.

Article 4 (Purchase Procedure and Payment Methods)

  1. Buyers must place orders through the sales platform designated by the Artist (e.g., Booth).

  2. For direct sales, buyers must contact the Artist via email. 

  3. International shipping is available.

  4. Buyers are responsible for shipping fees, customs duties, and any other applicable charges.

Article 5 (Delivery and Liability)

  1. Artworks displayed at exhibitions or galleries will be shipped after the exhibition period ends.

  2. The Artist shall ensure that the Artwork is securely packaged to prevent damage during shipping.

  3. The Artist shall not be held liable for any damages, delays, losses, or other incidents that occur after the Artwork has been handed over to the shipping carrier.

Article 6 (Returns, Exchanges, and Cancellations)

  1. Once a purchase is confirmed, returns, exchanges, and cancellations will not be accepted under any circumstances.

  2. Due to the nature of the Artwork, slight differences in texture or color do not constitute valid reasons for returns or exchanges.

  3. Buyers are deemed to have agreed to these Terms at the time of purchase.

Article 7 (Handling of Personal Information)

  1. The Artist shall strictly manage buyers' personal information and shall not disclose or provide such information to third parties unless required by law.

  2. Personal information shall only be used for purposes related to the sale and delivery of the Artwork.

​

Article 8 (Amendments to These Terms)

  1. The Artist may review and amend these Terms as necessary.

  2. If any amendments are made, buyers who purchase Artworks after the revision shall be deemed to have agreed to the updated Terms.
